New Chemical Regulations in Turkey and

SDS Directive 26/12/2008-27092/TR

"Compilation and Submission of Safety Data Sheets for Dangerous Substances and Preparations"

Main chemical regulations have changed in Turkey within last 2-3 years. As Turkish Ministry of Environment and Forestry (MoEF) aims to align local regulations to EU and UN directives especially about the chemicals a fast adaption process has been projected.

Within this project MoEF prepares and issues directives regarding the produced and imported chemicals.

These Regulations can be summarized as: 

- SDS Directive of 27092 
- Chemical Control and Inventory directive 
- Classification Labeling and Packing of the Dangerous chemicals and preparations.

Those directives are issued on December 2008 and come in to force on 26 December 2009.

And also there are progresses about the directives which are already in the pipeline as : 

- SEVESO II 
- CLP/ GHS Harmonization 
- REACH implementation 
- Cosmetics directive 
- Detergents directive

Below mentioned regulations are mainly held by MoEF and other Ministries such as Health and Occupation and Social Security are in coordination. 

- SDS Directive of 27092

- Classification Labeling and Packing of the Dangerous chemicals and preparations.

- CLP/ GHS Harmonization 
- REACH implementation

And listed directives are handled by Mo Health, with the coordination of the other ministries and institutes.

As an exporter to Turkey, you should be in compliance with the below mentioned directives by their deadlines respectively:
- SDS Directive of 27092

Briefly to be in compliance with this directive you should supply a Turkish SDS in compliance with the directive which is authorized by a licensed expert . 
- Classification Labeling and Packing of the Dangerous chemicals and preparations:
Turkish legislation is aligned with the 29th ATP of 67/548 EEC. To be in compliance with the EEC 67/548 also maintains to be in compliance with the Turkish directive.

Turkish labels are needed.

These directives come in to force after the dead line of 26 December 2009. 
- Chemical Control and Inventory directive ( Dead line amended as 31 March 2011)

All chemicals that are produced in Turkey or imported to Turkey should be notified to the system by a Turkish Legal Entity with a lower limit of 1 mta.

In order to comply with that, exporters to Turkey might appoint a trustee or consultant who handles the responsibilities of an importer and prevent them to share all ingredients with the clients.

Regulations and Our Services

1. Consultancy and Support Services for compliance to ''Compilation and Submission of Safety Data Sheets In Accordance with the Turkish regulation regarding the ''Compilation and Submission of Safety Data Sheets'' (Reg. No: 27092 which came into force by 26 December 2009), SDS's have to be compiled by certificated personnel in Turkish with the Turkish chemical names and a copy of each should be submitted to the legal authorities.

With our competent and certificated expert team, we provide this service within Turkey including both the compilation and the submission of these SDS's to the legal authorities as requested by the regulation.

Regulation

According to the Regulation No 27092 of Turkish Ministry of Environment and Forestry of 26 December 2008 concerning the “Compilation and Submission of Safety Data Sheets for Dangerous Substances and Preparations”;
Under the relevant paragraphs of Article 5;

(1) The preparation of Safety Data Sheet is based on the following principles :

a) The manufacturer, importer or distributor responsible to provide a safety data sheet, contains the information of Article 7, Annex 1 and Annex 2 of this regulation, for the substances or preparations classified as hazardous according to the Regulation of the “Classification, Packaging and Labeling of The Dangerous Substances and Preparations” to the professional users of the products.

c) Safety data sheet of dangerous substances or preparations are provided free of charge in the first delivery and later if revised or updated. Updated or revised safety data sheet is transmitted within the period of 3 months to the users having the sheets updated on the period of 12 months before the last revision. Revision date and number is indicated in the sheet.

d) Safety Data Sheet is transmitted in electronic media and written texts.

e) Safety data sheets are prepared by the competent personnel certified by the accredited organizations in the field of preparing the safety data sheets. Safety data sheets are prepared by people with the same qualifications in imports.

f) Safety data sheets shall be prepared covering the information provided in Article 7 and in accordance with the format given in the examples of Annex-1

(2) A copy of the safety data sheets is forwarded to the relevant organization; an electronic copy is also forwarded to the Ministry of Environment and Forestry.

And in accordance with Article 6

1) Safety Data Sheet is written in Turkish.

No: 27092) which came into force by 26 December 2009), all substances that are produced in Turkey or substances that are imported to Turkey on their self or in a preparation over 1 mta with the exceptions mentioned on related annexes.

Requirements of Regulation on Chemical Inventory and Control

Those substances should be evaluated according to annual threshold and data requirements of the regulation should be submitted to the IT system HEDSET within the timeline set by the regulation.

Also if the authorities asks for additional data on substances that are reported those should be submitted within the time line.
